These Terms of Service (“Terms”) are a binding agreement between you and Mother and Father, Inc. (“Mother and Father,” “we,” “us,” or “our”), a Delaware corporation. They govern your access to and use of our website and application (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service is
Mother and Father provides educational content and organizational tools for pregnancy, preconception, and early parenthood, including a personalized household protocol, meal guidance, reminders, check-ins, and decision tracking for both parents.
2. Not medical advice
The Service is for general informational and educational purposes only and is not medical, nutritional, or professional advice. We are not a healthcare provider, and no doctor–patient relationship is created by your use of the Service. Always seek the advice of a qualified physician or other health provider with questions about a medical condition, pregnancy, diet, or treatment, and never disregard or delay seeking it because of something you read here. If you think you may have a medical emergency, call your doctor or 911 immediately.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate.
4. Your account
You sign in with Google, which is the only sign-in method. You are responsible for the activity that occurs under your account and for maintaining the security of your Google account. Notify us promptly at support@motherandfather.org if you believe your account has been compromised. You may not share your account or impersonate anyone else.
5. Households and partner invitations
The Service is organized around a household that may include two parents. If you invite a partner or accept an invitation, you understand that members of the same household can view and contribute to shared household information. Only invite people you intend to share that information with, and only accept invitations from people you know.
6. Subscriptions, free trial, and billing
- Free trial. Paid features may begin with a free trial (for example, 7 days). Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.
- Recurring billing. Subscriptions are billed in advance on a recurring basis (for example, monthly) through our payment processor, Stripe, until cancelled. By subscribing, you authorize us and Stripe to charge your payment method for each billing cycle.
- Cancellation. You may cancel at any time through your account or billing portal. Cancellation takes effect at the end of the current billing period, and you will retain access until then.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.
- Price changes. We may change subscription prices. We will give you advance notice, and changes apply to billing periods after the notice.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems;
- Reverse engineer, scrape, or copy the Service except as permitted by law;
- Upload content that is unlawful, infringing, or harmful, or that you do not have the right to share; or
- Use the Service to harass, harm, or impersonate others.
8. Content and intellectual property
The Service, including its content, software, and design, is owned by Mother and Father or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own household’s personal, non-commercial use. You retain ownership of the information you submit (“Your Content”), and you grant us a license to use, store, and process Your Content as needed to operate and improve the Service.
9. Third-party services
The Service relies on third parties such as Google, Stripe, and others. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for them.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any content or guidance will meet your needs or produce any particular outcome.
11. Limitation of liability
To the fullest extent permitted by law, Mother and Father and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Mother and Father from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where applicable law provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Effective” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
